Le service <strong><u>MTN SmartPay<\/u> <\/strong>est une facilit\u00e9 qui permet aux clients \u00e9ligibles d\u2019acqu\u00e9rir un t\u00e9l\u00e9phone ou tout autre dispositif \u00e9lectronique commercialis\u00e9 dans les march\u00e9s de t\u00e9l\u00e9phones ou par MTN moyennant un paiement diff\u00e9r\u00e9 et \u00e9chelonn\u00e9.<\/p>\n\n\n\n<p>La souscription et l\u2019utilisation du service MTN SmartPay implique l\u2019acceptation sans r\u00e9serve et l\u2019application pleine et enti\u00e8re des pr\u00e9sentes Conditions G\u00e9n\u00e9rales qui pr\u00e9valent sur toute autre condition \u00e9manant du Client et\/ou sur tout autre document non express\u00e9ment accept\u00e9 par \u00e9crit par MTN Cameroon.<\/p>\n\n\n\n<ol style=\"list-style-type:upper-roman\" class=\"wp-block-list\">\n<li id=\"<p-class=&quot;justifie-officiel&quot;&gt;---Mobile-T\u00e9l\u00e9phone-Networks-Cameroon-(ci-apr\u00e8s-MTNC),-Soci\u00e9t\u00e9-Anonyme-dont-le-si\u00e8ge-social-est-au-360,-Rue-Drouot,-Bonamouti-Akwa,-B.P.-15574-Douala-Cameroun,-commercialise-le-service-MTN-SmartPay-(Le-Service)-sur-le-territoire-national.-Le-service-MTN-SmartPay-est-une-facilit\u00e9-qui-permet-aux-clients-\u00e9ligibles-d\u2019acqu\u00e9rir-un-t\u00e9l\u00e9phone-ou-tout-autre-dispositif-\u00e9lectronique-commercialis\u00e9-dans-les-march\u00e9s-de-t\u00e9l\u00e9phones-ou-par-MTN-moyennant-un-paiement-diff\u00e9r\u00e9-et-\u00e9chelonn\u00e9.-<\/p&gt;\" class=\".justifie {   text-align: justify;   text-align-last: justify;   hyphens: auto; }  .officiel {   font-family: &quot;Times New Roman&quot;, serif;   font-size: 16px;   line-height: 1.8; }\"><strong>OBJET<\/strong><\/li>\n<\/ol>\n\n\n\n<p>Les pr\u00e9sentes Conditions G\u00e9n\u00e9rales d\u00e9finissent les conditions et modalit\u00e9s selon lesquelles, MTNC fournit le Service MTN SmartPay (Le \u00ab&nbsp;Service&nbsp;\u00bb) \u00e0 tout Client d\u00e9sireux d\u2019acqu\u00e9rir un t\u00e9l\u00e9phone ou tout autre accessoire \u00e9lectronique (Le \u00ab&nbsp;Terminal&nbsp;\u00bb).<\/p>\n\n\n\n<ol style=\"list-style-type:upper-roman\" class=\"wp-block-list\">\n<li><strong>&nbsp;&nbsp;D\u00c9FINITIONS<\/strong><\/li>\n<\/ol>\n\n\n\n<p>Pour l\u2019application des pr\u00e9sentes conditions g\u00e9n\u00e9rales, les termes utilis\u00e9s dans le pr\u00e9sent document ont la d\u00e9finition suivante lorsqu\u2019ils sont employ\u00e9s avec une premi\u00e8re lettre majuscule, qu\u2019ils soient utilis\u00e9s au singulier ou au pluriel :<\/p>\n\n\n\n<p>MTN SmartPay : d\u00e9signe le service d\u2019achat de Terminaux par paiement \u00e9chelonn\u00e9.<\/p>\n\n\n\n<p>MTN MoMo : d\u00e9signe le moyen de paiement mobile \u00e0 travers lequel l\u2019utilisateur s\u2019engage \u00e0 r\u00e9gler les \u00e9ch\u00e9ances de paiement.<\/p>\n\n\n\n<p>Dates de Remboursement : d\u00e9signe les dates auxquelles les \u00e9ch\u00e9ances mensuelles de paiement des Terminaux sont dues.<\/p>\n\n\n\n<p>Montant \u00e0 rembourser : d\u00e9signe le montant \u00e0 payer \u00e0 une Date de Remboursement au titre du service MTN SmartPay, y compris tous les frais de service et les \u00e9ventuelles p\u00e9nalit\u00e9s.<\/p>\n\n\n\n<p>Client : d\u00e9signe toute personne physique r\u00e9sidant au Cameroun, titulaire d&#8217;une ligne t\u00e9l\u00e9phonique MTN et ayant souscrit au service MTN. Il doit en outre \u00eatre titulaire d\u2019un compte MoMo.<\/p>\n\n\n\n<p>Client \u00e9ligible&nbsp;: toute personne identifi\u00e9e par MTN comme pouvant \u00eatre b\u00e9n\u00e9ficiaire du service MTN SmartPay , v\u00e9rifiable via le code *189#.<\/p>\n\n\n\n<p>R\u00e9f\u00e9rent&nbsp;: Toute personne d\u00e9sign\u00e9e par le Client comme pouvant valablement recevoir pour son compte des notifications qui lui sont destin\u00e9es.<\/p>\n\n\n\n<p>Terminal&nbsp;: T\u00e9l\u00e9phone portable ou tout autre appareil vendu par MTNC dans le cadre du service MTN SmartPay<\/p>\n\n\n\n<ol style=\"list-style-type:upper-roman\" class=\"wp-block-list\">\n<li><strong>ABONNEMENT AU SERVICE MTN SMARTPAY<\/strong> <\/li>\n<\/ol>\n\n\n\n<p>Pour b\u00e9n\u00e9ficier du service MTN SmartPay, le Client doit \u00eatre \u00e2g\u00e9 d\u2019au moins 21 ans et r\u00e9sider sur le territoire camerounais.<\/p>\n\n\n\n<p>Le Client doit \u00e9galement fournir les noms et num\u00e9ros de t\u00e9l\u00e9phone d\u2019un R\u00e9f\u00e9rent qui peut \u00eatre contact\u00e9 s\u2019il n\u2019est pas joignable<\/p>\n\n\n\n<p>Toute personne d\u00e9sireuse de s\u2019abonner au Service doit accepter les Conditions G\u00e9n\u00e9rales via le code *244# ou remplir et signer la fiche de souscription relative au Service MTN SmartPay et pr\u00e9ciser le type de Terminal choisi. La signature de la fiche de souscription vaut acceptation sans r\u00e9serve des pr\u00e9sentes Conditions G\u00e9n\u00e9rales.<\/p>\n\n\n\n<p>Le Client re\u00e7oit de MTNC, une confirmation comprenant notamment les d\u00e9tails sur le Service souscrit, ainsi que la liste des informations et documents \u00e0 fournir notamment&nbsp;:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Ses nom(s), pr\u00e9nom(s), date de naissance, profession, adresse postale et adresse email<\/li>\n\n\n\n<li>Les noms, pr\u00e9noms, num\u00e9ro de CNI et adresse email du R\u00e9f\u00e9rent<\/li>\n\n\n\n<li>Tout document attestant de l\u2019existence l\u00e9gale de la personne (pi\u00e8ce d\u2019identit\u00e9 valide).<\/li>\n\n\n\n<li>Num\u00e9ro de t\u00e9l\u00e9phone.<\/li>\n<\/ul>\n\n\n\n<p>Le Client doit fournir \u00e0 MTNC des informations et documents dont il garantit l\u2019exactitude, la validit\u00e9 et la compl\u00e9tude. Le Client devra informer MTNC en cas de modification de ces informations.<\/p>\n\n\n\n<p>Toute notification envoy\u00e9e aux adresses indiqu\u00e9es par le Client sera r\u00e9put\u00e9e avoir \u00e9t\u00e9 valablement ex\u00e9cut\u00e9e.<\/p>\n\n\n\n<ol style=\"list-style-type:upper-roman\" class=\"wp-block-list\">\n<li><strong>&nbsp;DUREE ET PAIEMENT<\/strong><\/li>\n<\/ol>\n\n\n\n<p>Le service MTN SmartPay prend effet \u00e0 compter de la date du paiement de la premi\u00e8re \u00e9ch\u00e9ance qui doit intervenir au moment de la mise \u00e0 disposition du Terminal, et reste en vigueur jusqu\u2019\u00e0 la date du paiement de la derni\u00e8re \u00e9ch\u00e9ance.<\/p>\n\n\n\n<p>Le Client s\u2019engage \u00e0 payer les Terminaux aux prix et selon les mensualit\u00e9s d\u00e9finis dans le formulaire de souscription<\/p>\n\n\n\n<p>Les paiements anticip\u00e9s sont autoris\u00e9s, mais ne pourront pas r\u00e9duire le co\u00fbt final du Terminal.<\/p>\n\n\n\n<p>Le Client devra payer les autres \u00e9ch\u00e9ances par MTN MoMo via le code *244# ou tout autre code indiqu\u00e9 par le service MTN SmartPay sur son t\u00e9l\u00e9phone portable.<\/p>\n\n\n\n<p>En cas de non-remboursement, le client autorise MTN \u00e0 bloquer son t\u00e9l\u00e9phone, sa carte SIM et \u00e0 faire d\u00e9biter son compte mobile money indiqu\u00e9 dans le formulaire de souscription et tout autre compte mobile money lui appartenant aupr\u00e8s de Mobile Money Corporation (MMC) aux fins d\u2019obtenir le remboursement du montant impay\u00e9, ou \u00e0 recouvrer sa cr\u00e9ance par tout autre moyen.<\/p>\n\n\n\n<p>Le Terminal ne sera d\u00e9bloqu\u00e9 qu\u2019apr\u00e8s paiement total des montants dus.<\/p>\n\n\n\n<ol style=\"list-style-type:upper-roman\" class=\"wp-block-list\">\n<li><strong>NOTIFICATIONS<\/strong><\/li>\n<\/ol>\n\n\n\n<p>Toutes les notifications relatives au Service et les SMS (Short Message Service) seront envoy\u00e9s aux num\u00e9ros de t\u00e9l\u00e9phone et \/ ou aux adresses email du Client et du R\u00e9f\u00e9rent, afin de rappeler notamment au Client les Dates de Remboursement et les montants \u00e0 rembourser.<\/p>\n\n\n\n<ol style=\"list-style-type:upper-roman\" class=\"wp-block-list\">\n<li><strong>&nbsp;RESPONSABILITES DES PARTIES<\/strong><\/li>\n<\/ol>\n\n\n\n<ol style=\"list-style-type:lower-alpha\" class=\"wp-block-list\">\n<li><strong>&nbsp;Responsabilit\u00e9s du Client<\/strong><\/li>\n<\/ol>\n\n\n\n<p>Le Client a l\u2019obligation, jusqu\u2019au paiement int\u00e9gral des sommes dues au titre du Service, d\u2019utiliser une Sim MTN comme sim principal dans le Terminal acquis au titre du Service MTN SmartPay au risque de voir son Terminal bloqu\u00e9.<\/p>\n\n\n\n<p>Le Client accepte et reconna\u00eet que, sous r\u00e9serve des cas de mise en \u0153uvre de la garantie pour vice de fabrication, il a l&#8217;enti\u00e8re responsabilit\u00e9 de tout Terminal acquis dans le cadre des pr\u00e9sentes et ne peut en aucun cas rechercher la responsabilit\u00e9 de MTN pour toute panne ou dysfonctionnement.<\/p>\n\n\n\n<p>Pour faire jouer la garantie le cas \u00e9ch\u00e9ant, le Client informera imm\u00e9diatement MTN et se rendra sans d\u00e9lais aupr\u00e8s de l\u2019Agence de MTN muni du Terminal en bon \u00e9tat de pr\u00e9sentation dans son emballage d\u2019origine.<\/p>\n\n\n\n<p>Le Client aura la responsabilit\u00e9 de respecter les d\u00e9lais fix\u00e9s et de s\u2019acquitter des versements mensuels.<\/p>\n\n\n\n<p>Aucun litige entre le Client et MTNC ne donnera le droit au Client de suspendre ses obligations de paiement des sommes dues au titre du service MTN SmartPay.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Responsabilit\u00e9s de MTNC<\/strong><\/li>\n<\/ul>\n\n\n\n<p>MTNC sera tenu de r\u00e9parer tout dysfonctionnement li\u00e9 au d\u00e9faut de fabrication ou vice cach\u00e9 ou de remplacer le Terminal au cas o\u00f9 l\u2019incident se produit durant la p\u00e9riode de garantie.<\/p>\n\n\n\n<p>MTNC ne sera pas responsable de toute panne caus\u00e9e par la mauvaise manipulation du Terminal ou par la n\u00e9gligence du client.<\/p>\n\n\n\n<ol style=\"list-style-type:upper-roman\" class=\"wp-block-list\">\n<li>&nbsp;<strong>LOI APPLICABLE ET JURIDICTION<\/strong><\/li>\n<\/ol>\n\n\n\n<p>Les pr\u00e9sent Conditions G\u00e9n\u00e9rales sont r\u00e9gies par la loi camerounaise.<\/p>\n\n\n\n<p>Tout litige d\u00e9coulant ou en relation avec les pr\u00e9sentes Conditions G\u00e9n\u00e9rales et non r\u00e9solu \u00e0 l\u2019amiable sera soumis \u00e0 la comp\u00e9tence des tribunaux de Douala, Yaound\u00e9, Garoua, Buea et Bamenda.<br><br><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p><\/p>\n\n\n\n<div style=\"height:100px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><u>&nbsp;CONDITIONS GENERALES DU SERVICE MTN SMARTPAY<\/u><\/strong><\/h2>\n\n\n\n<ol style=\"list-style-type:upper-roman\" class=\"wp-block-list\">\n<li><strong>PREAMBLE<\/strong><\/li>\n<\/ol>\n\n\n\n<p>Mobile Telephone Networks Cameroon (hereinafter referred to as MTNC), a limited company with its registered office located at 360 Rue Drouot, Bonamouti-Akwa, P.O. Box 15574, Douala-Cameroon, markets the MTN SmartPay service (hereinafter referred to as &#8220;The Service&#8221;) throughout the national territory.<br>The MTN SmartPay service provides eligible customers with the ability to acquire a phone or any other electronic device sold in device markets or by MTN through deferred and installment payments.<br>Subscription to and use of the MTN SmartPay service implies unconditional acceptance and full application of these General Terms and Conditions, which prevail over any other conditions from the Client and\/or any document not explicitly accepted in writing by MTN Cameroon.<\/p>\n\n\n\n<ol style=\"list-style-type:upper-roman\" class=\"wp-block-list\">\n<li>PURPOSE<\/li>\n<\/ol>\n\n\n\n<p>These General Terms and Conditions define the terms and conditions under which MTNC provides the MTN SmartPay service (&#8220;The Service&#8221;) to any Customer wishing to acquire a phone or any other electronic accessory (&#8220;The Device&#8221;).<\/p>\n\n\n\n<ol style=\"list-style-type:upper-roman\" class=\"wp-block-list\">\n<li><strong>&nbsp;&nbsp;DEFINITION<\/strong><strong>S<\/strong><\/li>\n<\/ol>\n\n\n\n<p>For the purpose of these General Terms and Conditions, the terms used in this document have the following meanings when capitalized, whether used in the singular or plural:<\/p>\n\n\n\n<p><strong>MTN SmartPay<\/strong>: Refers to the installment-based purchasing service for Devices.<\/p>\n\n\n\n<p><strong>MTN MoMo<\/strong>: Refers to the mobile payment platform through which the user commits to making payment installments.<\/p>\n\n\n\n<p><strong>Repayment Dates<\/strong>: Refers to the dates on which monthly installment payments for Devices sold are due.<\/p>\n\n\n\n<p><strong>Amount to be Repaid<\/strong>: Refers to the amount to be paid on a Repayment Date under the MTN SmartPay service, including all service fees and any applicable penalties.<\/p>\n\n\n\n<p><strong>Customer<\/strong>: Refers to any individual residing in Cameroon, holding an MTN phone line, and having subscribed to the MTN SmartPay service. They must also hold a MoMo account.<\/p>\n\n\n\n<p><strong>Eligible Customer<\/strong>: Any individual identified by MTN as eligible for the MTN SmartPay service, verifiable via the code *189#.<\/p>\n\n\n\n<p><strong>Referee<\/strong>: Any individual designated by the Customer as authorized to receive notifications on their behalf.<\/p>\n\n\n\n<p><strong>Device<\/strong>: Mobile phone or any other device sold by MTNC under the MTN SmartPay service.<\/p>\n\n\n\n<ol style=\"list-style-type:upper-roman\" class=\"wp-block-list\">\n<li><strong>SUBSCRIPTION TO THE MTN SMARTPAY SERVICE<\/strong><\/li>\n<\/ol>\n\n\n\n<p>To benefit from the MTN SmartPay service, the Customer must be at least 21 years old and reside within Cameroon.<br>The Customer must also provide the names and phone numbers of a Referee who can be contacted if the Customer is unreachable.<\/p>\n\n\n\n<p>les d\u00e9tails sur le Service souscrit, ainsi que la liste des informations et documents \u00e0 fournir notamment&nbsp;:<\/p>\n\n\n\n<p>Any individual wishing to subscribe to the Service must accept the General Terms and Conditions through *244# &nbsp;or complete and sign the subscription form for the MTN SmartPay Service and specify the type of Device chosen. Signing the subscription form constitutes unconditional acceptance of these General Terms and Conditions.<\/p>\n\n\n\n<p>The Customer will receive confirmation from MTNC, which will include details of the subscribed Service, as well as a list of the required information and documents, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Their full name(s), date of birth, profession, postal address, and email address.<\/li>\n\n\n\n<li>The Referee&#8217;s full name(s), ID card number, and email address.<\/li>\n\n\n\n<li>Any document confirming the legal identity of the individual (valid ID).<\/li>\n\n\n\n<li>Phone number.<\/li>\n<\/ul>\n\n\n\n<p>The Customer must provide MTNC with information and documents that they guarantee to be accurate, valid, and complete. The Customer must notify MTNC of any changes to this information.<br>Any notification sent to the addresses provided by the Customer will be considered validly delivered.<\/p>\n\n\n\n<ol style=\"list-style-type:upper-roman\" class=\"wp-block-list\">\n<li><strong>&nbsp;DURATION AND PAYMENT<\/strong><\/li>\n<\/ol>\n\n\n\n<p>The MTN SmartPay service takes effect from the date of payment of the first installment, which must be made at the time the Device is provided and remains in effect until the date of payment of the final installment.<br>The Customer agrees to pay for the Devices at the prices and according to the installment plan defined in the subscription form.<\/p>\n\n\n\n<p>Early payments are allowed but will not reduce the final cost of the Device.<br>The Customer must pay subsequent installments via MTN MoMo using the code *244# or any other code provided by the MTN SmartPay service on their mobile phone.<br>In case of non-repayment, the Customer authorizes MTN to block their phone, SIM card, and to debit the mobile money account indicated in the subscription form, as well as any other mobile money account they own with Mobile Money Corporation (MMC), in order to recover the unpaid amount, or to collect the debt by any other means.<\/p>\n\n\n\n<p>The Device will only be unlocked after full payment of the amounts due.<\/p>\n\n\n\n<ol style=\"list-style-type:upper-roman\" class=\"wp-block-list\">\n<li><strong>NOTIFICATIONS<\/strong><\/li>\n<\/ol>\n\n\n\n<p>All notifications related to the Service and SMS (Short Message Service) will be sent to the phone numbers and\/or email addresses of the Customer and the Referee, specifically to remind the Customer of the Repayment Dates and the amounts to be repaid.<\/p>\n\n\n\n<ol style=\"list-style-type:upper-roman\" class=\"wp-block-list\">\n<li><strong>&nbsp;RESPONSIBILITIES OF THE PARTIES<\/strong><\/li>\n<\/ol>\n\n\n\n<ol style=\"list-style-type:lower-alpha\" class=\"wp-block-list\">\n<li><strong>&nbsp;<\/strong><strong>Responsibilities of the Customer<\/strong><\/li>\n<\/ol>\n\n\n\n<p>The Customer is required, until full payment of the amounts due under the Service, to use an MTN SIM card as principal SIM in the Device acquired through the MTN SmartPay Service otherwise the Terminal may be blocked.<\/p>\n\n\n\n<p>The Customer accepts and acknowledges that, except in cases of warranty claims for manufacturing defects, they bear full responsibility for any Device acquired under these terms and cannot hold MTN liable for any malfunction or defect.<\/p>\n\n\n\n<p>To activate the warranty, if applicable, the Customer must immediately notify MTN and promptly visit an MTN Agency with the Device in good condition and in its original packaging.<br>The Customer is responsible for adhering to the established deadlines and making the monthly payments.<br>No dispute between the Customer and MTNC will entitle the Customer to suspend their payment obligations under the MTN SmartPay service.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Responsibilities of MTNC<\/strong><\/li>\n<\/ul>\n\n\n\n<p>&nbsp;MTNC shall be responsible for repairing any malfunction related to manufacturing defects or hidden faults or replacing the Device if the issue occurs during the warranty period of 6 months.<\/p>\n\n\n\n<p><br>MTNC shall not be held liable for any malfunction caused by improper handling of the Device or negligence on the part of the Customer.<\/p>\n\n\n\n<ol style=\"list-style-type:upper-roman\" class=\"wp-block-list\">\n<li>&nbsp;<strong>APPLICABLE LAW AND JURISDICTION<\/strong><\/li>\n<\/ol>\n\n\n\n<p>These General Terms and Conditions are governed by Cameroonian law.<\/p>\n\n\n\n<p>Any dispute arising from or related to these General Terms and Conditions that cannot be resolved amicably will be subject to the jurisdiction of the courts in Douala, Yaound\u00e9, Garoua, Buea, and Bamenda.<br><br><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p><strong>BILE TELEPHONE NETWORKS CAMEROON LIMITED<\/strong><\/p>\n\n\n\n<p>360, Rue Drouot Akwa \u2013 B.P.15574 Douala Cameroun, Soci\u00e9t\u00e9 Anonyme (S.A.) au Capital de 4.400.000.000 FCFA<\/p>\n\n\n\n<p>N* RC\/DLA\/2000\/B\/p\/ &#8211; N Contr.&nbsp;: M099800009100C, Tel.&nbsp;: +237 679 00 90 00 \/ +237 679 00 90 45 \u2013 FAX&nbsp;: +237 679 00 90 40<\/p>\n\n\n\n<p><\/p>","protected":false},"excerpt":{"rendered":"<p>CONDITIONS GENERALES DU SERVICE MTN SMARTPAY Mobile T\u00e9l\u00e9phone Networks Cameroon (ci-apr\u00e8s MTNC), Soci\u00e9t\u00e9 Anonyme dont le si\u00e8ge social est au 360, Rue Drouot, Bonamouti-Akwa, B.P. 15574 Douala-Cameroun, commercialise le service MTN SmartPay (Le Service) sur le territoire national.
